Welcome to Moots! These Terms of Service ("Terms") govern your use of the Moots application (the "Service") operated by MUNDUSMK (PTY) LTD ("we," "us," or "our"). By accessing or using the Service, you agree to be bound by these Terms. If you do not agree to these Terms, please do not use the Service.

1. User Accounts and Eligibility

  • Account Creation: You must provide accurate and complete information when creating an account via our authentication provider, Clerk.
  • Security: You are responsible for safeguarding your account credentials. MUNDUSMK (PTY) LTD cannot and will not be liable for any loss or damage arising from your failure to comply with this security obligation.
  • Age Requirements: You must be at least 13 years old to use the Service, or 16 years old if residing in the European Economic Area.

2. User-Generated Content (UGC) and Ownership

Moots is a Proof of Work network, which means your content is the core of the experience.

  • Your Ownership: You retain 100% of the intellectual property rights to any code, projects, posts, links, or comments (collectively, "Content") you submit, post, or display on the Service.
  • License to MUNDUSMK (PTY) LTD: By posting Content on Moots, you grant us a worldwide, non-exclusive, royalty-free license to use, copy, reproduce, process, adapt, modify, publish, transmit, display, and distribute such Content in any and all media or distribution methods specifically for the purpose of operating, promoting, and improving the Service.

3. Moderation and Termination Rights

We want Moots to remain a high-signal environment for builders.

  • Right to Moderate: We reserve the right (but have no obligation) to review, refuse, or remove any Content that we deem, in our sole discretion, to violate these Terms or our Acceptable Use Policy.
  • Account Termination: We reserve the right to suspend or terminate your account, delete your projects, or restrict your access to the Service at any time, for any reason, with or without notice, at our sole discretion.

4. Copyright and DMCA Policy

MUNDUSMK (PTY) LTD respects the intellectual property rights of others. If you believe your copyright has been infringed by content hosted on Moots, please send a written takedown notice to mundusmk.support@gmail.com detailing the copyrighted work, the location of the infringing material on our Service, and your contact information.

5. Disclaimer of Warranties ("As Is" Clause)

The Service is provided on an "AS IS" and "AS AVAILABLE" basis. MUNDUSMK (PTY) LTD expressly disclaims all warranties of any kind, whether express or implied, including, but not limited to, the implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

  • We make no warranty that the Service will meet your requirements, be uninterrupted, timely, secure, or error-free.
  • We do not guarantee that any data, project logs, or network connections will be preserved.

6. Limitation of Liability

To the maximum extent permitted by applicable law, in no event shall MUNDUSMK (PTY) LTD be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses, resulting from:

  • Your access to or use of, or inability to access or use, the Service.
  • Any conduct or content of any third party on the Service.
  • Any unauthorized access, use, or alteration of your transmissions or content.

7. Indemnification

You agree to defend, indemnify, and hold harmless MUNDUSMK (PTY) LTD from and against any claims, liabilities, damages, losses, and expenses, including, without limitation, reasonable legal and accounting fees, arising out of or in any way connected with your access to or use of the Service, your Content, or your violation of these Terms.

8. Governing Law

These Terms shall be governed by and construed in accordance with the laws of South Africa, without regard to its conflict of law provisions. Any legal action or proceeding arising under these Terms will be brought exclusively in the courts located in South Africa.

9. Changes to Terms

We reserve the right, at our sole discretion, to modify or replace these Terms at any time. We will provide notice of any material changes by posting the new Terms on the Service.
